Welcome to eCloud Card (“Company,” “we,” “our,” or “us”).
These Terms and Conditions (“Terms”) govern your use of eCloudCard.com, its subdomains, applications, and services (collectively, the “Platform”).
By accessing or using the Platform, you agree to these Terms. If you do not agree, please do not use the site or services.

1. Description of Services

eCloud Card provides a digital business card and white-label SaaS platform that enables users and resellers to create, customize, distribute, and manage digital business cards (“Cards”) and related analytics.
We also offer a reseller program allowing approved users to white-label and resell our services under their own branding.

2. Eligibility

You must be at least 18 years old to use our services. By registering, you confirm that all information you provide is accurate and that you have the authority to enter into this agreement.

3. Account Registration & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to notify us immediately of any unauthorized use or breach of security.
We reserve the right to suspend or terminate any account at our discretion if we detect misuse or violation of these Terms.

4. Subscription Fees & Payments

Certain features of the Platform require payment, including but not limited to:

  • Digital business card subscriptions
  • Reseller or white-label licenses
  • Add-on features or analytics tools

All prices are in U.S. dollars. Payments are processed securely through our third-party provider (e.g., Stripe or Square).
Subscriptions automatically renew unless canceled before the next billing period.
We reserve the right to modify pricing or features at any time, with notice provided to active users.

Refund Policy: Due to the digital nature of our services, all sales are final. Refunds are issued only in cases of verified billing error or duplicate charge.

5. Reseller & White-Label Program

Approved resellers may promote and sell the Platform under their own brand name.
Resellers agree not to misrepresent the product, make false claims, or compete unfairly with eCloud Card.
All content, software, code, and underlying intellectual property remain the exclusive property of eCloud Card.
Reseller access may be revoked for misuse, late payments, or violation of these Terms.

6. Intellectual Property

All materials on eCloudCard.com — including but not limited to text, code, graphics, logos, software, and trademarks — are owned by or licensed to eCloud Card.
You may not copy, distribute, reproduce, or modify any portion of the Platform without written consent.

White-label resellers are granted a limited, non-exclusive license to use the eCloud Card system under their own branding while maintaining full compliance with these Terms.

7. Acceptable Use Policy

You agree not to use the Platform to:

  • Post or share illegal, harmful, or misleading content
  • Infringe upon intellectual property rights
  • Upload viruses, bots, or malicious code
  • Collect personal data without consent
  • Misrepresent your affiliation with eCloud Card or its partners

We may suspend or delete any content or account that violates these rules.

8. Limitation of Liability

To the fullest extent permitted by law, eCloud Card, its owners, employees, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform.
Our total liability shall never exceed the total amount paid by you in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Platform is provided “as is” and “as available.”
We make no guarantees regarding uptime, speed, accuracy, or reliability.
We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Termination

We reserve the right to suspend or terminate your account, with or without notice, for any reason — including violation of these Terms, abuse, or fraudulent activity.
Upon termination, all rights granted to you under these Terms immediately cease.

11. Indemnification

You agree to indemnify, defend, and hold harmless eCloud Card and its affiliates from any claims, damages, or losses (including legal fees) arising out of your misuse of the Platform or breach of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict of law principles.
Any dispute shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona.

13. Modifications to Terms

We may update or modify these Terms at any time. The latest version will always be posted at https://ecloudcard.com/terms.
Continued use of the Platform after changes constitutes acceptance of the revised Terms.
