Terms of Service
These terms explain the rules for using the eCloudCard website, digital-card platform and reseller services.

1. About eCloudCard
eCloudCard provides digital business cards and a white-label software platform that allows individuals, companies and authorized resellers to create, customize, manage and distribute mobile-friendly business profiles. Available features may include NFC and QR-code sharing, contact links, media, forms, analytics and related services.
2. Eligibility and Accounts
You must be at least 18 years old and legally able to enter into a binding agreement. You agree to provide accurate account information, keep login credentials secure and notify eCloudCard promptly if you believe your account has been compromised. You are responsible for activity conducted through your account.
3. Services and Availability
Features, templates, storage, support and service levels may vary by plan. We may improve, modify or discontinue features when reasonably necessary. We work to maintain reliable service but do not promise that every feature will be available without interruption or error.
4. Fees, Billing and Renewals
Current prices, setup fees and billing schedules are disclosed when you enroll or purchase. Recurring services may renew automatically until canceled according to the terms presented at purchase. You authorize the applicable charges and are responsible for taxes or third-party fees associated with your account.
Except where required by law or stated in a written offer, payments already earned or services already delivered are nonrefundable. Failure to pay may result in suspension or termination of access.
5. Reseller and White-Label Programs
Authorized resellers may market eligible eCloudCard services under an approved business name or domain. Resellers are independent businesses—not employees, partners or legal agents of eCloudCard—and may not make guarantees or claims that eCloudCard has not approved.
- City or territory availability is subject to written confirmation.
- A city name or domain does not create ownership of a geographic market unless a separate written agreement states otherwise.
- Resellers are responsible for their own sales practices, customer relationships, taxes, licenses and legal compliance.
- Income examples are illustrative only. No sales, revenue or profit is guaranteed.
- Use of eCloudCard branding, software and materials remains subject to our permission and brand standards.
6. Domains and Branding
Domain availability cannot be guaranteed until registration is complete. Domain registration, renewal, transfer and ownership terms may be described in a separate order or reseller agreement. You may not use a domain, company name or design that violates another party’s trademark, privacy or intellectual-property rights.
7. Acceptable Use
You agree not to use the services for unlawful, deceptive, abusive or harmful activity. You may not upload malicious code, attempt unauthorized access, interfere with the platform, send spam, impersonate another person, infringe intellectual property, or publish content that violates applicable law or another person’s rights.
8. Customer Content
You retain ownership of content you submit. You grant eCloudCard a limited license to host, process, display and transmit that content only as needed to provide and support the services. You represent that you have permission to use all submitted names, logos, images, videos, contact information and other materials.
9. Intellectual Property
The eCloudCard platform, software, designs, documentation, trademarks and original materials belong to eCloudCard or its licensors. Except for the limited rights provided by your plan or written reseller agreement, you may not copy, reverse engineer, resell, sublicense or distribute the platform or proprietary materials.
10. Third-Party Services
The services may contain links, integrations or embedded content provided by third parties. eCloudCard does not control those services and is not responsible for their content, availability, security or privacy practices. Your use of third-party services may be governed by separate terms.
11. Support
Support is available through the channels and hours stated on the website. Response times may vary. You agree to provide enough information for us to investigate technical issues and to cooperate with reasonable troubleshooting steps.
12. Suspension and Termination
You may stop using the services at any time, subject to outstanding charges and applicable cancellation terms. We may suspend or terminate access for nonpayment, misuse, legal risk, security threats or material violation of these terms. When practical, we will provide notice and an opportunity to correct the issue.
13. Disclaimers
The services are provided “as is” and “as available” to the fullest extent permitted by law. eCloudCard does not guarantee uninterrupted operation, a particular number of leads, sales, customers, card views, revenue or profits. You are responsible for evaluating whether the services meet your business needs.
14. Limitation of Liability
To the fullest extent permitted by law, eCloudCard will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, goodwill or business opportunities. Our total liability for a claim will not exceed the amount you paid to eCloudCard for the affected service during the twelve months before the event giving rise to the claim.
15. Indemnification
You agree to defend and indemnify eCloudCard against third-party claims, losses and reasonable expenses arising from your content, your violation of these terms, your unlawful conduct, or your operation of a reseller business.
16. Governing Law
Unless a separate written agreement states otherwise, these terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any permitted legal action will be brought in a court with jurisdiction in Arizona.
17. Changes to These Terms
We may update these terms to reflect changes in our services, business or legal obligations. The updated version will be posted with a revised date. Continued use after an update becomes effective means you accept the revised terms.
